These Terms and Conditions apply to the use of www.novaelectrical.co.za and to purchases from Nova Electrical Supplies (Pty) Ltd (“Nova Electrical”, “we”, “us” or “our”) through the website or an approved written quotation. They must be read with our Returns, Warranty and Delivery Policy and Privacy Policy.

Nothing in these terms excludes or limits a right or remedy that cannot lawfully be excluded or limited under South African law, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).


1. About Nova Electrical

Nova Electrical is a South African supplier of lighting, electrical, networking and related products. Our company and contact details appear in section 17 below.

2. Using this website

You may browse the website and buy products for lawful purposes. You must not interfere with the website, attempt unauthorised access, introduce malicious code, misuse product or pricing information, or use the website in a way that infringes another person’s rights.

You are responsible for checking that the details you submit are accurate. Before placing an online order, checkout allows you to review the order, correct mistakes or leave without completing the purchase.

3. Product information and suitability

We take reasonable care to keep product names, descriptions, images, prices, dimensions, specifications and stock information accurate. Supplier feeds and catalogues can contain errors or update after a listing is published. If we identify a material error, we will explain it and provide lawful options before fulfilling the affected item.

Images are illustrative unless stated otherwise. Packaging, branding or minor appearance details may change, but we will not knowingly substitute a materially different product without your agreement. Please ask us before ordering if a dimension, colour, specification, certification, compatibility requirement or delivery deadline is critical.

Product-selection guidance is based on the information you give us. Electrical products must be selected, installed and used for their intended application and by a suitably qualified person where required by the product or the law.

4. Prices, VAT and promotions

Prices are in South African rand and include VAT unless the relevant page, quotation or checkout clearly states otherwise. Delivery charges and the final order total are shown during checkout or confirmed in writing before the order is accepted.

Promotional prices, bulk prices and quotations may be limited by time, quantity or available stock. We may correct an obvious pricing, calculation or listing error before accepting an order. If an error affects an amount already paid, we will contact you and, depending on the circumstances, offer the corrected transaction, a suitable alternative with your agreement, or a refund. We will not force a substitution.

5. Stock and order acceptance

Adding an item to a cart or receiving an automated order-received message does not reserve stock or mean that we have finally accepted the order. Your order is an offer to buy. It becomes binding when Nova Electrical expressly accepts it after checking stock, payment and fulfilment, or when we dispatch the goods.

Before acceptance, we may decline an order where stock is unavailable, a material listing error exists, payment has not cleared, delivery cannot reasonably be completed, legal or supplier restrictions apply, or the transaction appears fraudulent. If we cannot accept an order after receiving payment, the affected amount will be refunded without an administration deduction.

Urgent, project, contractor, bulk and special-order customers should confirm availability and lead time before payment.

6. Payment and fraud prevention

Orders are processed after cleared payment unless we have approved written account terms. Available payment methods are the options displayed at checkout or stated in a written quotation. Payment providers process payment information under their own secure systems and terms.

Do not send card details by email, messaging service or contact form. We may perform reasonable verification or fraud checks and may place an order on hold while we verify it. A request for verification does not entitle anyone to ask for your password, one-time PIN or full card details.

7. Delivery, risk and ownership

We deliver to valid street addresses within South Africa. Customer collection is not currently available. Delivery charges, estimates, address requirements, damaged-delivery reporting and failed-delivery rules are explained in our Returns, Warranty and Delivery Policy.

Delivery dates are estimates unless we expressly agree to a firm date in writing. We will notify you if goods are unavailable or materially delayed and provide the options required by law. Risk in goods passes on delivery to the address you nominated, subject to applicable law. Ownership passes once Nova Electrical has received full payment.

8. Cancellations and online cooling-off rights

Contact us as soon as possible if you want to cancel an order. If the order has not been dispatched or committed as a lawful non-cancellable special order, we will confirm the cancellation and any refund due. If it has already been dispatched, the applicable return process will apply.

Where section 44 of ECTA applies to an electronic transaction, a consumer may cancel without reason and without penalty within seven days after receiving the goods. The consumer may be responsible only for the direct cost of returning the goods, and an amount paid before cancellation must be refunded within 30 days after cancellation.

ECTA contains exclusions, including certain personalised, made-to-specification, non-returnable-by-nature, rapidly perishable and unsealed software or recording products. These exclusions do not remove rights concerning defective, unsafe, misrepresented or incorrectly supplied goods.

9. Returns, faulty goods and refunds

Returns, incorrect deliveries, transit damage, inspection, refunds and product-specific warranty claims are handled under our Returns, Warranty and Delivery Policy.

Where section 56 of the CPA applies and goods fail to meet the statutory quality standards within six months after delivery, the consumer may return them without penalty and at the supplier’s risk and expense and may direct the supplier to repair or replace the goods, or refund the price paid, subject to the CPA. No wording in these terms removes that remedy.

10. Additional product warranties

Any warranty in addition to statutory rights is product-specific. Its period and conditions must appear on the product page, quotation, invoice, packaging or manufacturer documentation. If no additional period is stated, Nova Electrical does not promise a blanket multi-year commercial warranty.

Additional warranties may exclude misuse, unauthorised modification, operation outside specification, voltage surge, unsuitable environmental conditions, exceeded IP ratings or incorrect installation. Those exclusions apply only to the additional warranty and do not remove rights that cannot lawfully be excluded.

11. Customer accounts and communications

You are responsible for keeping account login details confidential and for notifying us promptly if you suspect unauthorised use. Order, payment, delivery, security and service messages may be sent using the contact details supplied with the order.

Marketing messages are separate from essential order communications. We will send electronic marketing only as permitted by law, and you may unsubscribe using the method provided in the message.

12. Privacy and security

Our Privacy Policy explains what personal information we collect, why we use it, how we share it with payment, delivery and service providers, and how to exercise your privacy rights.

We use reasonable safeguards and payment systems intended to be sufficiently secure for the transaction. No internet service can be guaranteed to be completely secure or uninterrupted. Please contact us promptly if you believe your order or account information has been compromised.

13. Website availability and third-party services

The website may occasionally be unavailable because of maintenance, hosting, security, connectivity or technical issues. Links to third-party websites and services are provided for convenience. Their content, availability and separate terms are controlled by those third parties.

Payment gateways, couriers, manufacturers and other service providers may have their own operational rules. Those rules do not override consumer rights or Nova Electrical’s obligations under applicable law.

14. Intellectual property

The Nova Electrical name, website design, original text, graphics and other website material are owned by or licensed to Nova Electrical unless stated otherwise. You may view and print reasonable extracts for personal purchasing or internal business evaluation, but may not reproduce, sell, scrape or commercially exploit the website material without permission.

Manufacturer names, product images and trade marks remain the property of their respective owners.

15. Liability and events outside our control

To the extent permitted by law, Nova Electrical is not liable for indirect, special or consequential business losses caused by website interruption, supplier or courier delay, stock shortage, a customer’s incorrect product selection, incorrect installation, misuse or use outside product specifications.

This limitation does not exclude liability or a consumer remedy that cannot lawfully be excluded, including liability arising from gross negligence where exclusion is prohibited, or rights relating to unsafe or defective goods.

Neither party is responsible for delay caused by events reasonably beyond its control. The affected party must act reasonably to reduce the effect of the delay. This clause does not remove any cancellation or refund right created by law.

16. Complaints, governing law and changes

These terms are governed by the laws of the Republic of South Africa. Please contact us first so that we can try to resolve a complaint promptly. Nothing prevents a consumer from approaching a competent consumer authority, ombud where applicable, or South African court.

We may update these terms to reflect changes in the business, website or law. The version applying to an order is the version available when that order is placed, unless a later change is required by law or benefits the customer. The effective date above identifies the current version.

If any provision is unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply.
